TERMS OF SERVICE
1.1 Vendor Performance and Liability
In case of accidents, riots, strikes, epidemics, acts of God, or other uncontrollable events, Vendor will make efforts to find replacement entertainment. If unable, Client gets a full refund. Vendor's liability is limited to the performance fee.
1.2 Deposits and Payments
All deposits are nonrefundable upon contract signing. Balances, due on event day, are nonrefundable. Cancelled events by Client may reschedule within 365 days, subject to Vendor's availability.
1.3 Event Photography/Video
Vendor may photograph/video the event for promotional use, unless declined by Client.
1.4 Agreement Cancellation
Cancellation requires both parties' written consent. Client breaching the agreement pays the full event fee, 6% interest, and attorney fees.
1.5 Weather and Safety Provisions
"Rain or Shine" events are not affected by weather. Outdoor events require overhead shelter. Vendor may cancel if weather is dangerous, with no compensation impact.
1.6 Security and Equipment Safety
Vendor can stop performance if threatened. Client has 15 minutes to resolve. Full payment is required regardless.
1.7 Working Conditions
Client provides a 6x6 setup area and reliable power within 10 feet. Client is responsible for any power-related performance delays or equipment damage.
1.8 Performance Control
Client must submit music requests two weeks prior. Vendor tries to fulfill requests but isn't liable for unavailability.
1.9 Non-Payment Consequences
Vendor may seek court collection for non-payment, with Client bearing all associated costs.
1.10 Timing and Access
Vendor requires setup/takedown time and access. Early setup/late takedown incurs additional charges.
1.11 Agreement Authority
Signing party must be 18+ and authorized to enter this Agreement or assume personal responsibility.
1.12 Superseding Clause
This Agreement overrides others. Parts of it may be modified in writing.
1.13 Governing Law
Florida law governs this Agreement. Legal actions must be in Florida. The Client indemnifies Vendor against all claims.
1.14 Non-Waiver
Vendor's rights remain intact even if not exercised.
